1. Operator & Merchant of Record
The website neverest.online is operated by IGOR GAJIĆ PR NEVEREST, Patrijarha Pavla 64, 36221 Kraljevo, Republic of Serbia (PIB: 113153959).
All payments are processed by Paddle.com Market Limited (Judd House, 18-29 Mora Street, London, EC1V 8BT, UK), who acts as the Merchant of Record for all transactions. Paddle is responsible for billing, tax collection, and payment-related customer support. By purchasing, you enter into a contract with Paddle as the seller of record.
2. Scope of Services
Neverest offers digital products and services including website creation, website maintenance, payment integration, and multilingual text analysis (SaaS). Services are delivered remotely and digitally. Specific deliverables, timelines, and conditions are defined in individual project agreements or subscription plans.
3. Subscriptions & Billing
Subscription-based services are billed monthly or annually. Subscriptions renew automatically unless cancelled before the renewal date. Billing is handled by our authorised payment processor acting as Merchant of Record. Prices are shown inclusive or exclusive of applicable taxes depending on your jurisdiction, as determined at checkout.
4. Right of Withdrawal (EU Consumers)
EU consumers have the right to withdraw from a digital service contract within 14 days of purchase without giving any reason, provided the service has not yet been fully performed. If you expressly consent to early performance and acknowledge the loss of your right of withdrawal, this right is forfeited upon commencement of the service. Refund requests are handled by the Merchant of Record in accordance with their refund policy, accessible at checkout.
5. Cancellation Policy
Monthly subscriptions may be cancelled at any time via the billing portal linked in your purchase confirmation. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods unless required by applicable law.
6. Intellectual Property
All custom work product delivered under a project agreement becomes the property of the client upon full payment. SaaS products and APIs remain the intellectual property of Neverest. Clients receive a non-exclusive, non-transferable licence to use SaaS products during an active subscription.
7. Limitation of Liability
Neverest's liability is limited to the amount paid by the client in the three months preceding the claim, except in cases of gross negligence or wilful misconduct. Neverest is not liable for indirect, incidental, or consequential damages, including loss of profit or data.
8. US Users (CCPA / State Laws)

9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Serbia. For EU consumers, mandatory consumer protection provisions of their country of residence apply. Disputes shall first be attempted to be resolved amicably. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
10. Changes to These Terms
We reserve the right to update these Terms at any time. Continued use of our services after notification of changes constitutes acceptance of the updated Terms.
